Introduction
Welcome to Abhyashsuchi. These Terms of Service (“Terms”) govern your access to and use of our platform at https://abhyashsuchi.in/, including our website, apps, and all associated services.
Abhyashsuchi has grown from a publishing platform into a full ecosystem: Articles and Pulse (content publishing), Abhyora Learning (courses and lessons), Mock Tests and Assessments, a Creator Program, an Instructor Program, Job Listings, Community Features, and Digital Study Materials. These Terms apply across all of these services unless a specific program has its own separate agreement (e.g., Creator Terms, Instructor Terms), in which case that agreement supplements these Terms.
By creating an account, publishing content, enrolling in a course, taking a test, applying to a job, or simply visiting our website, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. Acceptance of Terms
By accessing or using Abhyashsuchi, you confirm you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein (including Creator Terms, Instructor Terms, Community Guidelines, and the Academic/Exam Integrity Policy, where applicable to your use).
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date. For material changes, we will provide additional notice — such as email or a prominent in-platform notice. Continued use after changes are posted means you accept the updated Terms.
2. Eligibility
To create an account and use the platform, you must be at least 18 years old. By registering, you confirm you meet this requirement.
Users between 13 and 17 may view publicly accessible content (such as articles and course previews) but may not register an account, publish content, purchase courses, or apply to jobs without verifiable parental or guardian consent, where such supervised access is explicitly offered.
By using the platform, you represent that:
- You are at least 18 years of age (or using a supervised account with verified parental consent, where offered)
- You have the legal capacity to enter into a binding agreement
- You are not barred from using our services under any applicable law
3. User Accounts
To access features such as publishing, enrolling in courses, taking tests, applying to jobs, or commenting, you need an account. When registering, you agree to:
- Provide accurate, complete, and current information
- Keep your account information updated
- Maintain the confidentiality of your login credentials
- Not share your account with others or allow unauthorized access
- Notify us immediately at [email protected] if you suspect unauthorized access
You are solely responsible for all activity under your account. Abhyashsuchi is not liable for loss or damage resulting from unauthorized access if you failed to keep your credentials secure. We reserve the right to refuse registration or suspend accounts where we believe there has been a violation of these Terms or a risk to the platform or its users.
4. Platform Services
Abhyashsuchi provides the following services, each subject to these Terms and any applicable program-specific policy:
- Articles & Pulse: publishing and reading of articles, short-form posts (“Pulse”), and Shorts.
- Abhyora Learning: structured courses, lessons, progress tracking, and certificates.
- Mock Tests & Assessments: practice tests, scored assessments, rankings, and performance analytics.
- Study Materials: downloadable notes, PDFs, and practice resources.
- Creator Program: tools and monetization features for independent content creators.
- Instructor Program: tools for building, publishing, and selling courses.
- Job Listings: job postings, applications, and employer/candidate matching.
- Community Features: comments, reviews, ratings, follows, and discussions.
We may add, modify, or discontinue any of these services at any time, as described in Section 19 (Platform Availability).
5. User Conduct
All users — whether reading, writing, learning, testing, hiring, or applying for jobs — agree not to:
- Treat others without respect or basic dignity, harass, bully, intimidate, or target other users
- Engage in coordinated inauthentic behavior to manipulate opinion, ratings, or rankings
- Cheat, impersonate another test-taker, or use unauthorized assistance during timed assessments
- Share, republish, or leak mock test or course content without authorization
- Upload malware, spyware, viruses, or other malicious code
- Spam, phish, scam, or otherwise deceive other users
- Abuse, threaten, or harass instructors, creators, or support staff
- Use bots or automated tools to interact with the platform without our permission
- Buy, sell, or transfer accounts
- Circumvent platform restrictions, paywalls, or access controls
- Impersonate any person, brand, or organization
Violating these standards may result in content removal, score invalidation, account suspension, or permanent termination.
6. Prohibited Content
You may not post, upload, or publish content that:
- Is illegal under applicable law
- Infringes the intellectual property, privacy, or other rights of any third party
- Contains explicit sexual content, including nudity or pornographic material
- Promotes or facilitates violence, terrorism, or harm to individuals or groups
- Harasses, threatens, or abuses specific individuals
- Constitutes hate speech targeting people based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Contains malicious code, phishing, or fraudulent schemes
- Contains personally identifiable information about others without consent
- Impersonates another person, brand, or organization
- Violates any additional content policy published on the platform
We reserve the right to determine, at our sole discretion, whether content violates these standards and to remove it without notice.
7. Misinformation and Harmful Content Policy
We do not permit:
- Deliberately false or fabricated news presented as factual reporting
- Health misinformation that could cause real-world harm
- Election and civic misinformation intended to mislead voters
- Manipulated media (deepfakes or deceptively altered images/videos)
- Content designed to exploit real-world crises for fraudulent purposes
Opinion, satire, and analysis are welcome when clearly labeled as such; deliberate disinformation is not. Creators who repeatedly publish harmful misinformation may be suspended or permanently banned.
8. Learning Platform Rules (Abhyora Learning)
- Course Access: Access duration (lifetime, subscription-based, or fixed-term) will be clearly stated at the time of purchase or enrollment. Access may be revoked for Terms violations, chargebacks, or fraudulent enrollment.
- Progress Tracking: Your progress, quiz results, and completion status are recorded to power certificates and recommendations, as described in our Privacy Policy.
- Certificates: Certificates are issued upon meeting course-specific completion criteria and reflect completion of that specific course, not accreditation by any external body unless explicitly stated. We reserve the right to revoke a certificate obtained through cheating, fraud, or violation of these Terms.
- Instructor Interaction: Communicate with instructors respectfully; abusive conduct toward instructors may result in suspension.
- Study Material Usage: Downloadable materials are licensed for personal use only (see Section 15, Downloadable and Premium Content) and may not be redistributed.
9. Mock Test and Assessment Rules
Mock tests and assessments on Abhyashsuchi/Abhyora are provided for educational and self-assessment purposes. The following rules apply:
- Unauthorized AI assistance, external help, or collaboration is prohibited during timed, scored assessments unless a test is explicitly marked as open-book or AI-assisted.
- Sharing test questions, answer keys, or screenshots of assessments publicly, or outside the platform, is prohibited and may constitute a copyright violation.
- We may impose attempt limits on certain tests, which will be indicated at the time of the test.
- Rankings, leaderboard positions, or scores obtained through cheating, multiple fake accounts, or other unfair practices may be removed, and the associated account may be suspended.
- Results and rankings on Abhyashsuchi are estimates for practice purposes and do not constitute official scores of any government, board, or third-party examination. We make no guarantee that mock test performance predicts real exam outcomes.
- Where proctoring features (e.g., tab-switch detection) are used, this will be disclosed to you before the test begins, as described in our Privacy Policy.
10. AI Usage Policy
- Users must not use AI tools to generate answers during restricted, timed assessments unless the test is explicitly marked as permitting AI assistance.
- Submissions suspected of unauthorized AI-generated content during restricted assessments may be reviewed, flagged, and may result in score invalidation or account action.
- Where Abhyashsuchi offers its own AI-powered features (such as an AI learning assistant or AI-based search/recommendations), these are permitted for use only in the manner and context specified within the feature itself. Use of these features is also subject to our Privacy Policy (Section on AI Features).
- AI-generated recommendations and responses are provided for convenience and may contain errors; they do not replace instructor guidance or your own judgment.
11. Creator Terms
As a creator on Abhyashsuchi, you agree to:
- Only publish content you have the legal right to publish
- Be truthful and transparent about who you are and what you publish
- Clearly disclose sponsored, paid, or promotional content (see Section 17, Advertising and Sponsored Content Disclosure)
- Respect the intellectual property rights of others
- Keep published content accurate and updated where relevant
- Engage with readers and community respectfully
Creators are independent publishers, not employees or agents of Abhyashsuchi. Content reflects the creator’s views, not ours, and we do not endorse or verify the accuracy of creator-published content. Creator revenue sharing, payouts, and eligibility are governed by Section 16 (Creator Earnings) and any separate Creator Terms/monetization agreement.
12. Instructor Terms
As an instructor publishing courses on Abhyashsuchi, you agree to:
- Meet our course quality standards, including accurate course descriptions, learning outcomes, and pricing
- Ensure the accuracy of course content and update it where materially outdated or incorrect
- Submit courses for review prior to publishing, where our review process applies
- Set pricing within any platform-defined bounds and honor stated refund implications for your course
- Communicate with enrolled students in a professional and timely manner
- Provide reasonable notice to enrolled students before making material changes to a published course
We may review, suspend, or remove courses that violate these Terms, misrepresent outcomes (e.g., guaranteeing exam success or job placement), or receive a sustained pattern of valid student complaints.
13. Job Platform Terms
- Job Seekers: You are responsible for the accuracy of your resume, application materials, and profile information. You may withdraw an application or delete your candidate profile at any time.
- Employers: You are responsible for the accuracy and legality of job postings, and agree to use candidate data solely for legitimate recruitment purposes related to the posted role, consistent with our Privacy Policy. Discriminatory job postings, or postings for illegal roles, are prohibited.
- Abhyashsuchi is a listing and matching platform; we do not guarantee employment outcomes, the legitimacy of every employer, or the accuracy of every job listing, though we take reasonable steps to moderate postings.
14. User-Generated Content License
By submitting, posting, or publishing any content (“User Content”) — including articles, Pulse posts, comments, reviews, course materials, or resumes — you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, and modify (for formatting purposes only) your content in connection with operating, promoting, and improving the platform.
This license does not transfer ownership. You retain full ownership of your content and can remove it at any time. The license ends when you delete your content or account, except where content has already been distributed by others or cached by third-party services (e.g., search engines), which we cannot control.
You represent and warrant that you own or have the right to license your content to us, that it does not infringe any third-party rights, and that it complies with these Terms and applicable law.
15. Downloadable and Premium Content
Content made available for download (study materials, notes, practice files, course resources) is licensed, not sold. You receive a limited, non-exclusive, non-transferable license to use such content for personal purposes only, unless otherwise stated. You may not redistribute, resell, repackage, or sublicense downloaded content without our express written permission.
16. Payments, Refunds, and Creator/Instructor Earnings
Payments
- Course purchases, subscriptions, and other paid features are processed through third-party, PCI-compliant payment gateways. We do not store your full card details.
- Prices, applicable taxes, and promotional pricing will be clearly displayed before purchase.
- We are not responsible for failed transactions caused by your payment provider or bank.
Refund Policy
- Eligible purchases, refund windows, and non-refundable items (e.g., after significant course completion, or for mock test attempts already used) will be specified in our Refund & Cancellation Policy at the time of purchase.
- Refund requests are reviewed to prevent abuse (e.g., repeated purchase-refund cycles to access content for free).
- Processing times for approved refunds will be stated in the Refund & Cancellation Policy.
Creator and Instructor Earnings
- Creators and instructors participating in monetization programs (subscriptions, tipping, ad revenue share, course sales) earn revenue according to the terms of the applicable program, disclosed at the time of enrollment in that program.
- Payouts require identity/tax verification and a minimum payout threshold, if applicable, and follow a payout schedule disclosed in-platform.
- Creators and instructors are solely responsible for providing accurate tax information and complying with applicable tax obligations in their jurisdiction.
- We reserve the right to modify, pause, or discontinue monetization programs, with reasonable advance notice to affected creators/instructors for significant changes to active revenue-sharing arrangements.
- Payouts may be withheld or reversed where we determine, in good faith, that earnings resulted from fraud, fake engagement, or violation of these Terms.
17. Advertising and Sponsored Content Disclosure
Abhyashsuchi displays third-party advertisements, including through Google AdSense. Ads are clearly distinguishable from editorial content, and advertisers do not dictate publisher content.
If you are a creator who has received compensation — payment, free products, affiliate income, or other consideration — in exchange for publishing content, you must clearly disclose this within your post (e.g., “Sponsored,” “Paid Partnership,” or “This post contains affiliate links”). Failure to disclose may violate our policies and applicable consumer protection law. Abhyashsuchi is not liable for a creator’s failure to make required disclosures.
18. Intellectual Property
All design elements, branding, software, graphics, mock test question banks, and underlying technology that make up Abhyashsuchi — excluding User Content — are the exclusive property of Abhyashsuchi or its licensors, protected by copyright, trademark, and other applicable laws.
You may not:
- Copy, modify, distribute, sell, or sublicense any proprietary part of our platform (including question banks and course infrastructure)
- Use our name, logo, or branding without prior written consent
- Reverse engineer, decompile, or attempt to extract our source code
- Create derivative works based on our platform without permission
19. Copyright and DMCA Policy
Do not publish content that infringes the copyright, trademark, or other intellectual property rights of any person or entity. You represent that you own or have the legal right to publish any content you submit.
Filing a DMCA Takedown Notice: Send a written notice to [email protected] including:
- Identification of the copyrighted work you claim has been infringed
- Identification of the infringing material and its URL on our platform
- Your full name, address, telephone number, and email address
- A statement that you have a good-faith belief the use is unauthorized
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf
- Your physical or electronic signature
Upon receiving a valid notice, we will remove or disable access to the allegedly infringing material and notify the affected creator/instructor.
Counter-Notices: If you believe your content was removed by mistake or misidentification, submit a counter-notice to [email protected].
Repeat Infringers: We will terminate accounts of users found to be repeat infringers.
20. Content Moderation Rights
We reserve the right — but do not have the obligation — to:
- Review, screen, and moderate any content, including comments, reviews, courses, and mock test submissions
- Remove, restrict, or refuse to display content that violates these Terms or our policies
- Limit distribution of content determined to be low-quality, misleading, or harmful
- Add labels, notices, or context to disputed or sensitive content
We aim to make moderation decisions fairly and consistently, and will notify affected users where reasonably practicable, explaining the reason. Users may appeal moderation decisions by contacting [email protected]. We are not liable for our decisions to remove or retain content.
21. Academic and Exam Integrity
In addition to Section 9 (Mock Test and Assessment Rules), users agree not to:
- Engage in plagiarism in course assignments or submissions
- Impersonate another individual in any test, course, or certificate-related activity
- Engage in unauthorized collaboration during individually-assessed activities
- Circumvent attempt limits or proctoring measures
Violations may result in score invalidation, certificate revocation, and account suspension or termination.
22. Community Standards
Users are expected to:
- Treat others with respect and basic human dignity
- Engage in good faith and constructive discussion in comments, reviews, and forums
- Respect diverse perspectives and avoid inciting division based on identity
- Follow any additional Community Guidelines published on the platform
23. Third-Party Services and Links
The platform may include links to or integrations with third-party websites, tools, and services (payment processors, analytics, cloud hosting, video hosting, email providers), provided for convenience and not constituting endorsement. We do not control and are not responsible for the content, accuracy, privacy practices, or availability of third-party sites or services. Use of third-party services is at your own risk and subject to their own terms.
24. Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Where applicable, you may request an export of your personal data as described in our Privacy Policy (Data Portability).
25. Platform Availability
We do not guarantee uninterrupted, error-free access to the platform. We may perform maintenance, upgrades, or emergency repairs that temporarily limit access. We reserve the right to modify, suspend, or discontinue any part of the platform — including specific features like mock tests, courses, or job listings — at any time, with or without notice. We are not liable for inconvenience or loss caused by downtime or changes.
26. Disclaimer of Warranties
Abhyashsuchi is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and accuracy, reliability, or completeness of content.
Specifically:
- Educational content, courses, and mock tests are provided for learning and practice purposes only.
- We do not guarantee success in any competitive exam, certification, or job application as a result of using our platform.
- Course, test, and job listing information may change over time, and we do not warrant its continued accuracy.
- We do not warrant the accuracy, completeness, or reliability of content published by creators, instructors, or other users. You use the platform and rely on its content at your own risk.
27. Limitation of Liability
To the maximum extent permitted by law, Abhyashsuchi and its founders, officers, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities; loss of data or content; reputational harm; or cost of substitute services — including in connection with downtime, technical issues, third-party services, or user-generated content.
This applies regardless of whether we have been advised of the possibility of such damages and regardless of the theory of liability.
Our total aggregate liability to you for claims arising out of or related to these Terms or your use of the platform shall not exceed the greater of: (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) ₹500 INR (or the equivalent in your local currency).
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability; in those cases, our liability is limited to the fullest extent permitted by law.
28. Indemnification
You agree to defend, indemnify, and hold harmless Abhyashsuchi and its officers, directors, employees, contractors, agents, and affiliates from any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, content you publish or submit, your violation of these Terms or applicable law, your violation of any third party’s rights, or any claim that your User Content caused harm to another person. This obligation survives termination of your account and these Terms.
29. Account Suspension and Termination
We may suspend or permanently terminate your account, with or without prior notice, if:
- You violate these Terms or any Abhyashsuchi policy
- Your account is used for fraudulent, abusive, cheating, or illegal activity
- We receive a valid legal order requiring us to do so
- We determine, at our discretion, that your presence is harmful to the platform or community
You may close your account at any time by contacting [email protected]. See our Privacy Policy for what happens to your data upon deletion. Upon termination, your right to use the platform ceases immediately. Provisions including intellectual property rights, indemnification, disclaimers, and limitations of liability survive termination.
30. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. We encourage you to first contact [email protected] to resolve any dispute informally. If informal resolution is not possible, disputes are subject to the exclusive jurisdiction of the competent courts located in India.
31. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
32. Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements expressly incorporated by reference (Creator Terms, Instructor Terms, Community Guidelines, Refund & Cancellation Policy, Academic/Exam Integrity Policy, etc.), constitute the entire agreement between you and Abhyashsuchi regarding your use of the platform, superseding all prior agreements and understandings.
